Fuel Surcharge and Environmental Fee Information

Overview

WM Recycle America is committed to controlling costs so we can continue to provide you with the best overall value in recycling services. However, rising fuel prices and environmentally related compliance costs are something we cannot control and our Fuel Surcharge and Environmental Fee are meant to help us recoup these increased costs.

Fuel Surcharge

For all invoices dated on or after November 1st, 2006, we implemented a fuel surcharge to reflect the impact of changing fuel prices on our expenses.

The fuel surcharge calculation is tied directly to the national average price of diesel fuel as reported monthly by the Energy Information Administration of the U.S. Department of Energy ("EIA/DOE") in its Monthly Retail On-Highway Diesel Prices Index. This index is objective, publicly available and widely recognized in the trucking and transportation industries. This will ensure that you, our valued customer, will pay a fuel surcharge that is currently adjusted, easy to calculate, and equitable to you and the Company.

WM Recycle America will utilize the monthly average reported from the EIA/DOE. The WM Recycle America Fuel Surcharge Table shows what the fuel surcharge would be based upon the last monthly reported EIA/DOE national diesel price index prior to your invoice date. For example, if the last reported monthly EIA/DOE national diesel price index immediately preceding your invoice date was $2.78 per gallon, your fuel surcharge would be $0.95 per ton.

Environmental Fee

The Environmental Cost Recovery Fee covers the increase in our nation-wide costs associated with environmental safety and compliance, which have grown substantially since 2002. The environmental fee assessed to a customer is not tied to the specific increased environmental safety and compliance costs to service such customer, but to all environmentally-related costs to service all WM Recycle America customers on a nation-wide basis. These expenses include, but are not limited to, environmental permitting/testing, engineering and maintenance to maximize the recoverability of processed material, and the safe, environmentally responsible operation of all WM Recycle America facilities. Effective January 1, 2009 the Environmental Fee is $1.00 per ton. This charge will also be deducted from any rebate, or added to any charges.

Not a Governmental Tax; Future Changes

The Fuel Surcharge and Environmental Fee are not taxes or surcharges imposed by or remitted to any governmental or regulatory agency; it is our charge. The Fuel Surcharge and Environmental Fee may be changed at the discretion of WM Recycle America. To the extent required by your applicable customer service terms, the assessment of the Fuel Surcharge and Environmental Fee or any change to such charge is effective upon your acceptance of rebate payments from us or your payment of any such charges to us.

Q: If the price of fuel goes down, will my fuel surcharge component go down too?

A: Yes, if the Department of Energy's National Average price falls, your fuel surcharge component will come down as well. This information is updated monthly. If the cost of diesel fuel decreases, this will affect your fuel surcharge component.

Q: How can I see the value of the EIA/DOE Monthly Retail On-Highway Diesel Prices Index?

A: Here is the link to the EIA/DOE. This site is updated every Monday evening.

Q: Will the environmental charge component change each month?

A: No. The environmental charge will not fluctuate each month. It may be changed periodically if there is a substantial increase or decrease in our nation-wide costs associated with environmental compliance.
